Lack of will complicates McNair's estate

Nashville -- Tennessee lawyers say handling the estate of former NFL quarterback Steve McNair will be tricky because he left no will and had kids with different women.

Mechelle McNair has less than two months to complete an inventory of her late husband's assets, which according to state law, will be divided among her and McNair's four children, two of whom are from earlier relationships.

McNair was shot to death on July 4, allegedly by a woman with whom he was having an affair.

The (Nashville) Tennessean said Wednesday that McNair had two boys with Mechelle; however he also has two other sons. Paternity will have to be established, estate attorneys told the newspaper, after which Mrs. McNair gets a third and the sons get the rest.

"In these situations, a common term used is that it 'gets messy,'" Nashville layer Richard Johnson said. "A lot of times everybody has an opinion and it gets expensive. Leave a will."

State law also taxes estates worth more than $3.5 million at 50 percent unless they are shielded by trusts or other legal arrangements.

This is a huge FUMBLE on

This is a huge FUMBLE on Steves part, as the case with many of my (african-american) folks. The law about taxing 50% has been in place for years, theres no fighting that. Everything should NOT go to his wife, if everything was good between them he wouldnt have been cheating. Now the state will get 50% (again due to the fumble or lack of will) the rest should be divided between his mother and the wife.. as for the other kids Steve mom should do right by them. folks go to legalzoom.com and take care of YOUR business and lets prevent situations like this one. and by the way, I wrote a book (He Held His Own) about a similiar experience I had to this one.

Wive punished for husband's infidelity?

I cannot believe that you are suggesting that a wife should get less because she suffered more. Most infidelity doesn't have much to do with the spouse, but I don't think Steve McNair was unfaithful, I think he was setup.

First of all the state should not have anything to do
with any of Steves assets,After all he did have a wife
Michelle should have the say so.I think She is capable
of splitting everything.,"And i know should would do
right buy his 2 older children.,And if the older boys already have his last name the paternity has been estabilished.
