Motorola and RIM Sued Over Infringing Visual Voicemail Patent

A patent licensing firm-- Klausner Technologies, on Monday sued Research in Motion (RIMM) and Motorola (MOT) in separate lawsuits, for allegedly infringing its visual voicemail technology patents.


The lawsuit has been filed in the Federal Court of Eastern District of Texas (a venue known for getting quick trial for patent cases), represented by the California-based law firm Dover & Luner.

The plaintiff company is seeking damages and immediate injunction against the two for continuing with the use of patents.

In an official statement released, the company explained that, "The lawsuit is based on the recent unveiling by RIM of certain new 3G BlackBerry Bold 9700' mobile phones which use Klausner Technologies' Visual Voicemail patented technology."

Other companies sued by the Klausner in the past
It seems like Klausner Technologies is on a lawsuit filing trip, because it has already sued some big names in the market, including names like Apple, Google, LG Electronics, Cox Communications, Verizon, Vonage and Qwest, over one or other alleged infringements in the past.

It has also managed to win settlements in the past with Apple Inc. and LG Electronics.

Sprint Nextel, AT&T, eBay, Apple, and Verizon are among 24 companies that are now licensing the technology from the Klausner Technologies.

Reason for the lawsuit against the two mobile companies
According to the lawsuit documents filed against Motorola, the company’s new offering “CLIQ” mobile phone that runs on the Android operating system, uses visual voicemail technologies patented with Klausner Technology.

The company said in a statement that, “Various Blackberry models with the Visual Voicemail feature are already covered under [our] patent licenses granted to mobile operators. [We currently have] 24 visual voicemail patent licensees."

Other models by Motorola that use this feature are covered under the Klausner Technologies Visual Voicemail patent license granted to the mobile operators.

In another statement, the company also stated the reason for suing Research in Motion Ltd.; it has violated the same patent, as Motorola has, on its certain BlackBerry 9700 mobile phones. But the other phones by RIM have license from Klausner.

Research in Motion and Motorola declined to comment on the lawsuit filed against them.

These patents cover all the basic Visual Voicemail features in the mobile phones providing users an option to selectively view and listen to voice messages on their mobile phones or computers.

Klausner attracted the attention of the mobile phone industry in the end of the year 2007 when it sued Apple and six other mobile companies for $360 million, allegedly for the infringement of its visual voicemail technology patent.
