Chicago, June 18: Chris Brown suffered a blow yesterday after the California Supreme Court declined to intervene or delay his preliminary hearing. The R&B singer will face preliminary court hearing on the scheduled date, i.e. June 22, the court ruled Wednesday.
According to court records, the 19-year-old singer, who's charged with two felonies in an alleged attack on his ex girlfriend Rihanna, has lost his bid to delay the June 22 preliminary hearing in his assault case.
The crucial hearing will proceed as planned, the court records show. Brown is due back in court on Monday, June 22, 2009, for a preliminary hearing, after which a judge will determine whether enough evidence exists for his case to go to trial.
Brown’s request to delay hearing
Brown's lawyer, Mark Geragos, had asked the state's high court last week to intervene in the R&B singer's felony assault case.
Two judges from California’s Second District Court of Appeal had already rejected a similar petition filed by Geragos.
Facts of the case
Brown, who is charged with assault on his ex-girlfriend Rihanna- who has been subpoenaed as a witness, could face close to five years in prison, if convicted of the charges against him.
Brown and the 21-year-old Barbados-born singer Rihanna’s relationship has been on-again-off-again since the violent incident, in which Brown allegedly attacked his then girlfriend Rihanna, on the night of the Grammy Awards.
Brown, who dated Rihanna for a year until the assault incident in February, was arrested on Feb. 8 in Los Angeles on suspicion of causing physical injury and making criminal threats against his then girlfriend Rihanna, following a late-night dispute.
The "Disturbia" singer, who was subpoenaed last week, is due to appear in court to testify in the assault case against Brown at a preliminary hearing on June 22.
