Unauthorized App Store, Cydia Store, set up

California, March 8: Ever since Apple Inc (NASDAQ: AAPL; LSE: OHDZ; FWB: APC) opened the App Store, the iconic maker of iPhones has been at the receiving end of disparagement regarding the admittance policy. Quite a few well-liked applications were conspicuous by their absence in the App Store. This has led to the opening of the first unauthorized iPhone application store by the name of Cydia Store.

The Cydia Store is an initiative of Jay Freeman, the developer of the Cydia software installer for the iPhone. Freeman said of the store, “The overworking goal is to provide choice. It's understandable that Apple wants to control things, but it has been very limiting for developers and users."

The setting up the Cydia Store violates Apple's terms of service. It has been learnt that Freeman has already hired a lawyer to tackle any kind of legal issues arising out of the matter. Whether or not Apple will resort to legal action against the “unofficial” store and whether such an action will be successful remains to be seen.

The Digital Millennium Copyright Act (DMCA) might back Apple to a limited extent only as some legal experts opine that the present store has more to do with stifling competition than about copyright infringement. Susan Crawford, a professor at the University of Michigan Law School said, "Courts have said you shouldn't use the DMCA to leverage your copyright monopoly into other markets."

The App Store is an application and service centre for the iPhone and iPod Touch created by Apple Inc., which allows users to browse and download applications from the iTunes Store. The Cydia Store has been developed on similar lines but will have a selection of jailbroken Apps for iPhone users. It is estimated that 1.7 million iPhones on which Cydia software has been installed will have to be jailbroken.

Two more Cydia Stores are likely to be opened in the near future, one of which will focus on selling adult games for the iPhone. Freeman will charge a 30 percent commission from developers.
