Ashley Alexandra Dupre, the prostitute notorious for her alleged trysts with New York Gov. Eliot Spitzer, has filed suit against the "Girls Gone Wild" creators on Monday, alleging they exploited her image and name to advertise the racy videos.

The 22-year-old call girl, more famous as "Kristen," is suing the "Girls Gone Wild" founder Joe Francis for more than $10 million.

In her lawsuit, filed Monday in Miami federal court, Dupre claimed she never gave Francis permission to use her name and likeness to advertise the videos. Dupre contended she was 17, not old enough to sign legally binding contracts, when the videos were taken in 2003 in Miami Beach.

Dupre alleged she was vacationing in Miami Beach in 2003 when she was approached by Francis who offered her alcoholic drinks and persuaded her to expose her breasts before their cameras. According to Dupre’s lawyer, Richard C. Wolfe, she was later told by Francis to sign a video "release" form.

Since then, the racy video empire illegally exploited her name, picture, voice and likeness in a number of deceptive ad campaigns and on Web sites.

"At the time of these events, plaintiff did not understand the magnitude of her actions nor that her image and likeness would be displayed in videos and DVDs produced and distributed by defendants," the lawsuit reads.

"The defendants have profited from the filming, production and distribution and sale of the videos and DVDs," it added.

In the lawsuit "Girls Gone Wild" founder Joe Francis, two of his companies and a man purportedly involved in creation of two Internet sites that the lawsuit contends improperly use Dupre's image to sell DVDs and other products, are named as defendants.

Meanwhile, Francis said he was surprised by the lawsuit.

"It is incomprehensible that Ms. Dupre could claim she did not give her consent to be filmed by Girls Gone Wild, when in fact we have videotape of her giving consent, while showing her identification," Francis said in a statement.

He further said that the photos were taken in front of a room full of people, including two newspapers and multiple crews they had in the room.

"But I think it's ironic that she charged Gov. Spitzer 2,000 dollars for sex and she wants to charge me 10 million for taking some naked pictures of her," Francis told media. "I feel like I'm getting a raw deal."
