Andrew Thomas Gallo, 22, is charged with second degree murder -- as well as felony counts of fleeing from the scene of a traffic collision involving death or permanent injury, driving under the influence causing injury and driving with a .08 percent blood alcohol or higher causing injury.
The arraignment was postponed Monday at the request of defense attorney Randall Longwith, the Orange County Register reported. Superior Court Judge Roger Robbins raised Gallo's bail amount from $1 million to $2 million at Monday's hearing.
Orange County District Attorney Tony Rackauckas said Gallo faces sentencing enhancements for inflicting great bodily harm during the April 9 incident.
The newspaper said Gallo has a prior conviction in San Bernardino County for driving under the influence. He was reportedly driving with his license suspended at the time of the crash.
He faces a maximum sentence of 54 years and eight months to life in prison, Rackauckas said.
